Claimants, beware! Read our article on the recent High Court interim judgment in Asertis v Bloch, a case concerning alleged breaches of directors’ duties, in which Mark Whelan, Jonathan Barnett and Lucy Caton act for the defendant. The Mishcon de Reya team successfully obtained an order for security for costs on the basis that: 1) there was reason to believe that the Claimant could not satisfy an adverse costs order; and 2) the inadequacy of the Claimant's after the event insurance policy, notwithstanding the inclusion of an anti-avoidance provision.
